Terms of Use
These Terms of Use govern your use of Cardex. By downloading, installing, or using the app, you agree to these terms.
1. About Cardex
Cardex is a business card scanning and organization application. It allows users to capture or import images of business cards, recognize visible text, review detected information, and save selected details on their own device.
2. Acceptance of These Terms
By accessing or using Cardex, you confirm that you have read, understood, and agreed to these Terms of Use. If you do not agree with these terms, you should not use the app.
3. Permitted Use
Cardex is provided for lawful personal or business use. You may use the app to organize contact and business card information that you are legally entitled to possess and process.
- Do not use Cardex for unlawful purposes.
- Do not use the app to violate another person's rights.
- Do not intentionally misuse, interfere with, or attempt to damage the app.
- Do not use information obtained through the app in a way that violates applicable law.
4. User Responsibility for Saved Data
You are responsible for the information you scan, import, edit, store, and use in Cardex. You should ensure that your handling of personal information, contact details, and business card data complies with applicable privacy, data protection, employment, marketing, and communications laws.
5. Text Recognition and Accuracy
Cardex may use on-device text recognition to detect information from business card images. Recognition is automated and may be inaccurate. The app may incorrectly recognize, omit, duplicate, or misclassify names, phone numbers, email addresses, websites, social links, and other information.
You are responsible for reviewing recognized information before saving, contacting someone, or otherwise relying on that information.
6. Data Storage and iCloud
Cardex is designed to store saved business card information on your device. Depending on your Apple device and iCloud settings, data may also be stored or backed up in your personal iCloud account through Apple services.
The developer does not operate a separate server for storing your saved Cardex business card information and generally does not have access to that content.
7. Privacy
Your use of Cardex is also subject to the Cardex Privacy Policy, which explains how data is handled within the app.
8. No Analytics or Advertising Tracking
Cardex does not collect app usage analytics, behavioral profiles, advertising identifiers, or cross-app tracking information for the developer's own analytics or advertising purposes.
9. Third-Party Services
Cardex may rely on operating-system features and services provided by Apple, including iOS, camera and photo library permissions, on-device text recognition, App Store distribution, iCloud, and device backup functionality.
Apple services are governed by Apple's own terms, policies, and technical availability. The developer does not control Apple services and is not responsible for their operation, availability, security, or policies.
10. App Availability and Changes
Cardex may be changed, updated, suspended, or discontinued at any time. Features may be added, modified, removed, or made unavailable because of technical, legal, platform, security, or product requirements.
No guarantee is made that any particular feature will remain available permanently.
11. Software Errors
Cardex may contain bugs, defects, compatibility issues, incorrect behavior, crashes, or other software errors. Updates may correct some issues and may also introduce new issues.
12. No Professional Advice
Information stored or displayed by Cardex is provided only for organizational purposes. Cardex does not provide legal, financial, business, compliance, identity verification, or other professional advice.
13. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Cardex is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
No warranty is made that the app will be uninterrupted, secure, error-free, compatible with every device configuration, or that recognized or stored information will always be accurate, complete, current, or suitable for a particular purpose.
14. Limitation of Liability
To the maximum extent permitted by applicable law, the developer will not be liable for indirect, incidental, special, consequential, or similar losses arising from or related to the use of Cardex.
This includes, where legally permitted, losses resulting from incorrect recognized information, missed communications, incorrect contact details, data loss, device issues, interruption of service, or reliance on information stored or displayed by the app.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
15. Data Loss and Backups
You are responsible for maintaining appropriate device and iCloud backups if you wish to preserve your data. The developer cannot guarantee recovery of information that has been deleted, corrupted, lost, removed with the app, lost through device failure, or affected by operating-system or iCloud behavior.
16. Intellectual Property
Cardex, including its software, interface, branding, design, graphics, and original application content, is protected by applicable intellectual property laws. These Terms do not transfer ownership of the app or its intellectual property to you.
Business cards, names, logos, trademarks, and other content that you import or scan may belong to their respective owners.
17. App Store Terms
Your download and use of Cardex through Apple's App Store may also be subject to Apple's applicable App Store terms, licensing terms, and platform rules. Where required, those terms apply in addition to these Terms of Use.
18. Compliance with Law
You are responsible for using Cardex in accordance with the laws and regulations applicable to you, including applicable privacy and data protection laws such as the GDPR where relevant.
19. Termination of Use
You may stop using Cardex at any time by deleting the app. The developer may also discontinue or restrict the app where reasonably necessary for legal, security, technical, or platform-related reasons.
20. Changes to These Terms
These Terms of Use may be updated when Cardex changes or when legal, technical, or platform requirements change. The current version will be made available through the app or the official Cardex website.
Continued use of Cardex after updated Terms become effective may constitute acceptance of the updated Terms where permitted by applicable law.
21. Governing Law
These Terms are governed by the applicable laws of Slovakia and mandatory laws of the European Union, without depriving consumers of protections granted by mandatory laws that apply in their place of residence.
